In a stunning defeat for
private property activists,
Ouray County has successfully used Revised Statute 2477 to seize a
right of way for a public road to create shared access across the Camp
Bird property. This is the case that RS 2477 supporters have
been waiting for after a string of defeats! This ruling opens
the door to public use of private
property throughout the west for ATV, 4x4, and motorcycle
recreation. RS 2477 does not have a "just compensation"
clause, so there is no cost to counties who use this law to create
shared
access. Landowners who erect gates and refuse to provide access
do so at their own risk!

SWEETHEART DEAL
TAKES AWAY PUBLIC ACCESS IN CRYSTAL HEIGHTS!
County Commissioners in Nye County, Nevada, are illegally
attempting to take away public access rights granted by Congress in
1866. They have no right or authority to do this, any more than
they can take away the public's right to bear arms. Congress
granted RS 2477 rights to
the public, not to county governments. By helping a
wealthy developer shut down an established RS 2477 public highway, they
are providing an unfair windfall. This illegal closure will
greatly increase the value of the developer's land. It will
not come as any surprise if these anti-access commisioners end up with
a nice reward for this
sweetheart deal that will enhance the holdings of their friend.

WHAT CAN YOU DO TO SAVE OLD ASH MEADOWS
ROAD?
This is an established RS 2477 public highway.
Continue to use it. It cannot legally be gated. If you are
cited for trespassing by the sheriff, you are protected by RS 2477,
passed by Congress in 1866. To prosecute you, the county would
have to prove that Old Ash Meadows Road was not established under
Revised Statute 2477. Nye County cannot legally take away your
guns, and they cannot legally take away your access, because they do
not have the jurisdiction. These rights are protected by Federal
law.
THE RAMEY V. BOSLOUGH RS
2477 CASE IN BOULDER IS OVER.
We will write an article about this precident-setting case when we
get all the facts together. This is an enormous victory for
private property activists and a defeat for motorized recreation.
Because of this case, Boulder County is now strictly enforcing
trespassing laws on RS 2477 roads that cross private land. We
expect this to have a ripple effect across Colorado and the West.
According to legal and historical documents we have received,
Barking Dog Trail was not an
RS 2477 road. It was a private road all along! Old maps and
deeds demonstrate clearly that it was built by a mining company across
their own private property. You have to wonder why this case was
ever pursued, and why nobody bothered to do the research. Because
of Boslough v. Ramey, it is now much more difficult to file cases that
actually do involve RS 2477
roads!
Much of the plaintiff's case was based
on the erroneous opinions
stated in a 2002 editorial by the shared access rights
group,

However, the Mr. Ramey was never able
to get the support of the community when it came ot raising money or
finding witnesses that would testify in his favor.
