THE RAMEY V. BOSLOUGH RS 2477 DECISION IN BOULDER IS BEING APPEALED.

WE WANT FACTS!   WE WANT PICTURES!   WE WANT MAPS!   WE WANT NAMES!

We have gotten more email about this case than any other.  There seems to be no agreement about the facts.  One opinion is a 2002 editorial by the shared access rights group, offroad.com:

PUBLIC ACCESS WINS OUT OVER PRIVATE PROPERTY RIGHTS IN OURAY COUNTY, COLORADO!!

In a stunning defeat for private property activists, Ouray County has successfully used Revised Statute 2477 to seize a right of way for a public road to create shared access across the Camp Bird property.  This is the case that RS 2477 supporters have been waiting for after a string of defeats!   This ruling opens the door to public use of private property throughout the west for ATV, 4x4, and motorcycle recreation.  RS 2477 does not have a "just compensation" clause, so there is no cost to counties that use this law to create shared access.  Landowners who erect gates and refuse to provide access do so at their own risk!

RS 2477 rights-of-way are property rights originally granted by the federal
government to establish the transportation network essential to settlement
of the western frontier. Generally, these rights-of-way grants were made to
local governments and are held in trust by them for the public. Today, they
continue to provide virtually all the public access to and across the hundreds
of millions of acres of public and private lands in the West and Alaska.

In recent years these rights-of-way and the public's continued access to
these public and private lands has been increasingly threatened by a small
group of special interests, growing numbers of private landowners, and some
county, state, and federal bureaucrats.
